Houston, Texas (PressExposure) December 17, 2009 -- According to statistics released by the US government at the beginning of the decade roughly 35% of all nursing homes in the United States have been cited for abuse at some point. Attorney Joel A. Gordon of Joel A. Gordon and Associates in Houston announced this morning that he would be accepting new nursing home abuse cases for those in need of legal assistance.
âOur seniors and loved ones should not have to be subjected to abusive situations,â said a spokesperson for the firm. âWhen we leave our parents and grandparents in someone elseâs care we expect them to be taken care of. When that trust is violated those responsible should have to pay a price. Thatâs where legal representation becomes necessary and we are willing to provide it for those in need.â
According to the Nursing Home Reform Act of 1987, nursing home residents are guaranteed certain rights. Included among these rights is the right to photograph or document any injury and to file a complaint to the administrator about any abusive action committed against them. If either of these actions is prevented by a member of the nursing home staff it constitutes an act of abuse in itself.
âNot everyone knows their rights,â said our spokesperson. âWeâve published the main points of the Nursing Home Reform Act on our website so that patients can read up on what their rights are. If a patient feels those rights have been violated he or she can contact us and weâll evaluate the situation to see if legal action is justified. Itâs not always a clear case of physical abuse. Neglect can also result in adverse effects on seniors in nursing home care.â
